Our Reservations Rental Policies for the The Ruidoso River Resort & Inn … on the River!
I. TRUST ACCOUNT/HANDLING OF FUNDS AND PAYMENT PROCEDURES
- New Mexico Management/ NMM, LLC or Ruidoso River Resort may receive income from services to tenants, including, but not limited to, cleaning services and security deposits.
- Payments must be made at time of reservation.
- MasterCard, Visa, American Express and Discover cards are accepted for reservations.
- Tax rates in effect at the time of the printing of this agreement. Tenants are responsible for paying the tax rates in effect at the time the occupancy begins, this includes Gross Receipts Tax (7.8125%) and Lodgers Tax (5%).
- Rates and figures herein are subject to correction due to human or computer error.
II. CHECK-IN POLICY
- Check-in time is 4:00 P.M. NMM, LLC and/or Ruidoso River Resort will diligently work to insure that all properties are clean and ready for occupancy by 4:00 PM. However, in certain situations, it may be necessary to delay occupancy until the property is ready. There are no refunds for late occupancy. There are no early check-ins.
- Two keys provided per rental unit upon check-in. Lost keys - $100.00 each.
- To pick-up keys please go to the corresponding mail-box on the outside of Ruidoso River Resort
- Remove the packet with the packet corresponding room number and last name. Checkout Policy: All properties must be vacated by 12:00 NOON on checkout day or guest may be subject to a late checkout fee of $50.00 per hour. Please return keys to the locked key return box. If the checkout instructions are not done upon departure, or if the unit is left dirty there is an extra charge of $50.00 plus tax.
III. RENTAL PROPERTIES
- All units furnished with standard appliances of range, refrigerator, cookware and dinnerware.
- Linens are furnished.
- There will be NO REFUNDS due to any breakdown of appliances, A/C systems, TVs, DVDs, or other electronic equipment. Please report any problems and NMM, LLC and/or Ruidoso River Resort will contact a repair service technician immediately. Your patience will be appreciated as our area has limited repair service contractors. NO REFUNDS allowed due to any loss of utility services. Please contact NMM, LLC and/or Ruidoso River Resort and we will report the outage to the proper utility company. Tenant is required to report NMM, LLC the need of replacement or repair to a smoke detector and agrees to replace batteries as needed during tenancy (batteries will be provided by NMM, LLC). Please test smoke detectors upon arrival.
- All of NMM, LLC and/or Ruidoso River Resort Rental Properties include departure cleaning tenants are expected to dispose of all items in the refrigerator and place all trash outside in dumpsters. Failure to do so will result in an additional charge of $55.00 plus tax.
- Cleaning fees for the condos are $75.00 per visit. Cleaning fees are non-refundable.
IV. ACCOMMODATION RULES
- NMM, LLC agrees to provide the premises in a fit and habitable condition. If at the time Tenant is to begin occupancy NMM, LLC cannot provide the premises in a fit and habitable condition, or substitute a reasonable comparable property in such condition, NMM, LLC shall refund to Tenant all payments made by Tenant. NMM, LLC shall conduct all brokerage activities in regard to this agreement without respect to the race, color, religion, sex, national origin, handicap or family status of any tenant.
- Tenant agrees to keep the premises as clean and safe as the conditions of the premises permit and herby agrees to permit no unsafe or unsanitary conditions on the property. Tenant agrees not to use the premises for any activity or purpose that violates any criminal law or governmental regulation. Any breach of any duty contained in this paragraph shall be considered material, and shall result in the termination of Tenant’s tenancy.
- PETS: Small pets (40 lbs and under) will be allowed with $200.00 (refundable) deposit. Guests are requested to clean-up after their pets - no exceptions. Any damage or refuse will result in charges against the deposit.
- NUMBER OF OCCUPANTS: Overcrowding will not be permitted*. NMM, LLC and/or Ruidoso River Resort does not discriminate on the basis of race, religion, ethnic background or national origin, sex, age or mental or physical disability. (Condos Suit 2 people in a 1 bed-room, 4 people in a 2 bed-room, and 6 people in a 3 bed-room)
- NMM, LLC and/or Ruidoso River Resort will not rent property to anyone under the age of 18 nor will NMM, LLC and/or Ruidoso River Resort permit anyone under the age of 18 to take possession of any rental premises without the physical presence of a responsible party who is at least 18 years of age. No House Parties are permitted at any time. NMM, LLC and / or Ruidoso River Resort reserve the right to terminate the rental, without refund, if any renter or occupant violates any of these criteria.
- GRILLS: Gas grills are located in the courtyard area for use. Please clean grills after use. Fire Marshal regulations prohibit placing grills on decks. Each condo has grill utensils, please return them to units and not with grills.
- PARKING: On-site parking is limited, so please limit the number of vehicles to two vehicles per unit to avoid parking difficulties. Please check with the office if you will exceed two vehicles.
- Tenant agrees to indemnify and hold harmless NMM, LLC and Owner from and against any liability of personal injury or property damage sustained by any person (including Tenant’s guests) as a result of any cause, unless caused by the negligent or willful act of NMM, LLC or the owner. Tenant agrees that NMM, LLC, the Owner or their respective representatives may enter the premises during reasonable hours to inspect the premises, to make such repairs, alterations or improvements hereto as NMM, LLC or Owner may deem appropriate, or to show the premises to prospective buyers or tenants. Tenant shall not assign this Agreement or sublet premises in whole or part without written permission of NMM, LLC.
- MOTOR HOMES: No hook-up or use of any camper, bus, van, motor home or tent in conjunction with any rental property allowed. NO Motor Homes may be parked on the property.
- SMOKING: All NMM, LLC/Ruidoso River Resort properties are non-smoking. Smoking is NOT permitted on any property belonging to NMM, LLC/Ruidoso River Resort.
V. CANCELLATION POLICY
- Cancellation of a confirmed reservation is required in writing by mail or fax or email. Payment in full must be received by NMM, LLC and/or Ruidoso River Resort at the time the reservation is made. You may cancel 14 days prior to your arrival date, and receive a refund. If you cancel less than 14 days prior to your arrival, the payment will be non-refundable. NO EXCEPTIONS. Payments on reservations made inside the 14 day period will not be refunded if reservation is cancelled.
- Long term reservations, or major holiday reservation, may have different cancellation and refund policies. There are no refunds on unused lodging.
NOT FOLLOWING THESE RULES WILL RESULT IN BEING ASKED TO LEAVE THE PROPERTY. NO REFUNDS FOR UNUSED DAYS.
In the event any suit or action is filed arising out of or relating to this agreement, the non-prevailing party shall pay the attorney’s fees and costs of the prevailing party, whether related to arbitration, trial or appeal.
Online reservations or phone reservations authorize the representatives of NMM, LLC, to charge my credit card for the agreed upon rental fees and deposit. Consent to charge my credit card for any extra cleaning or damage to the condo that may occur during my stay is agreed upon and consented to upon check-in.
